About DuckLookup

Welcome to DuckLookup. These Terms of Use govern your access to and use of DuckLookup.com and related DuckLookup services.

By accessing or using DuckLookup, you agree to these Terms. If you do not agree, do not use the service.

DuckLookup is a service that helps people track the journeys of ducks using unique codes, QR codes, cruise information, sighting records, and related features.

DuckLookup is designed to follow the duck, not the person.

Unless expressly stated otherwise, DuckLookup is an independent service and is not affiliated with, endorsed by, sponsored by, or operated by any cruise line.

Using DuckLookup

You may use public DuckLookup features only for lawful purposes and in accordance with these Terms.

Some DuckLookup features may require an account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity that occurs through your account.

You may not use DuckLookup in a way that violates applicable law, interferes with the service, harms another person, or creates an unreasonable safety or security risk.

Sightings and location estimates

DuckLookup allows users to scan or enter duck codes and submit sightings.

A sighting may include information such as the duck, ship, sailing, date, time, approximate location, and an optional comment.

You do not need an account to submit certain sightings.

DuckLookup may delay publication of sightings for safety, privacy, moderation, operational, or technical reasons.

Submission of a sighting does not guarantee that the sighting or any related comment will appear publicly.

DuckLookup may estimate or display a duck's location using cruise schedules, ship-position information, sailing data, timestamps, and other third-party information.

DuckLookup does not require finders to provide their phone's GPS location.

Ship locations, port information, sailing schedules, timestamps, and related information may be delayed, incomplete, approximate, or inaccurate.

DuckLookup is not a navigation service. Do not rely on DuckLookup for navigation, emergency response, passenger location, vessel safety, or other safety-critical purposes.

Moves and corrections

Ducks may move between sailings, ships, ports, or other locations.

DuckLookup may provide features for recording a duck's move or correcting the sailing or time associated with a sighting.

DuckLookup may review, approve, reject, or correct submitted move information when reasonably necessary to preserve the accuracy or integrity of a duck's history.

Comments and moderation

You may be able to submit comments or other content through DuckLookup.

You agree not to submit content that includes personal contact information; cabin or room numbers; precise information about where a person or child can be found; private or confidential information; threats, harassment, hate, abuse, or sexual content; unlawful content; spam, advertising, or scams; content that infringes another person's intellectual-property rights; or other content DuckLookup reasonably determines is inappropriate for a family-friendly service.

Do not submit personal information about children or other users.

DuckLookup may review user-submitted content before or after publication.

DuckLookup may approve, reject, edit, hide, remove, or restrict content at its discretion when reasonably necessary to operate the service, enforce these Terms, protect users, or maintain a family-friendly environment.

DuckLookup may retain the original version of submitted content for moderation, safety, abuse prevention, recordkeeping, or legal purposes even when a different version is shown publicly.

There is no guarantee that any comment or submission will be published.

Your content

You retain ownership of content you submit to DuckLookup.

By submitting content, you give DuckLookup a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, modify for moderation or formatting purposes, and distribute that content as reasonably necessary to operate and promote the DuckLookup service.

This license ends when the content is no longer reasonably needed for those purposes, except where retention is necessary for security, moderation, legal, or recordkeeping reasons.

Prohibited conduct

You may not attempt to identify, locate, track, or profile a person through DuckLookup; use DuckLookup to monitor the movements of a child or other passenger; submit false or intentionally misleading sightings; manipulate duck histories or scan activity; attempt to access another user's account or private information; interfere with DuckLookup systems, security measures, rate limits, or access controls; scrape, crawl, or automatically collect DuckLookup data in a manner that burdens the service or violates applicable law; reverse engineer or misuse DuckLookup systems except where permitted by law; use DuckLookup for unlawful, abusive, deceptive, or fraudulent purposes; or encourage others to violate these Terms.

Codes, stickers, and ducks

DuckLookup codes and stickers are intended to help identify and track participating ducks.

DuckLookup does not guarantee that a sticker, QR code, short code, duck, or physical item will remain readable, attached, accessible, or in circulation.

Damaged, removed, lost, destroyed, duplicated, or misused stickers or codes may stop functioning as intended.

DuckLookup is not responsible for lost, damaged, confiscated, discarded, or inaccessible ducks.

Purchases

If DuckLookup offers products for sale, additional information regarding pricing, shipping, fulfillment, cancellations, refunds, or replacements may be shown during checkout or on the applicable product page.

You agree to provide accurate information when placing an order.

DuckLookup may cancel or refuse orders when reasonably necessary because of fraud, pricing errors, inventory issues, technical problems, legal requirements, or misuse of the service.

Service availability

DuckLookup may add, change, suspend, discontinue, or restrict any feature or part of the service.

We do not guarantee that DuckLookup will always be available; every duck can be successfully tracked; every scan will be recorded; every sighting will appear publicly; every ship or sailing will be available; every location will be accurate; historical data will remain available forever; or any particular feature will continue to exist.

Third-party services and references

DuckLookup relies on third-party services and data providers for certain functions, including hosting, infrastructure, cruise schedules, ship information, communications, moderation, and other operational services.

DuckLookup is not responsible for the accuracy, availability, policies, or performance of third-party services.

References to cruise lines, ships, ports, destinations, trademarks, or other third-party names are provided for identification and informational purposes.

Intellectual property

DuckLookup and its software, branding, logos, designs, text, graphics, and other materials are owned by DuckLookup or its licensors, except for third-party materials and user-submitted content.

You may not copy, reproduce, distribute, modify, sell, or commercially exploit DuckLookup materials except as permitted by law or with written permission.

Nothing in these Terms gives you ownership of DuckLookup trademarks or branding.

Enforcement

DuckLookup may restrict, suspend, or terminate access to the service if we reasonably believe a user has violated these Terms, created a safety or security risk, abused the service, interfered with operations, or engaged in unlawful activity.

We may also remove or deactivate ducks, codes, comments, accounts, or related records when reasonably necessary to protect the service or its users.

Disclaimers

DuckLookup is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, DuckLookup disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

We do not warrant that the service will be uninterrupted, error-free, secure, or accurate.

Limitation of liability

To the fullest extent permitted by law, DuckLookup and its owners, operators, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of DuckLookup.

This includes damages relating to lost or damaged ducks, inaccurate ship or location information, unavailable services, lost data, user-submitted content, or reliance on information displayed through DuckLookup.

Where liability cannot legally be excluded, DuckLookup's liability will be limited to the maximum extent permitted by applicable law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless DuckLookup and its owners, operators, affiliates, contractors, and service providers from claims, losses, liabilities, damages, and expenses arising from your unlawful use of DuckLookup, your violation of these Terms, or content you submit through the service.

Privacy

Your use of DuckLookup is also subject to the DuckLookup Privacy Policy.

The Privacy Policy explains how information is collected, used, stored, and disclosed.

Changes to these Terms

DuckLookup may update these Terms from time to time.

The updated version will be posted on DuckLookup.com with a revised "Last updated" date.

Your continued use of DuckLookup after updated Terms become effective constitutes acceptance of those updated Terms where permitted by law.

Governing law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from these Terms or the use of DuckLookup will be handled in a court of competent jurisdiction located in Nevada, unless applicable law provides otherwise.

Privacy Policy

Information you provide

DuckLookup helps people track the journeys of ducks hidden and found on cruise ships. We designed DuckLookup to follow the duck, not the person.

When you scan or enter the code for a duck, you may provide information such as a comment or other information requested as part of the sighting process.

You do not need to create an account to scan or log a duck sighting.

If you create or use an account, we may collect information such as your email address and information associated with sticker packs, orders, or batches assigned to your account.

Location information

DuckLookup does not ask finders to provide their phone's GPS location.

A duck's displayed location may instead be determined from information associated with the cruise ship, sailing schedule, ship-position data, and the time of the sighting.

Because this information comes from third-party ship and schedule data, displayed locations may be approximate or delayed.

Public duck histories

DuckLookup is designed to create a public history of a duck's journey.

Information that may appear publicly includes the duck's activity, ship, approximate location, date and time of a published sighting, and approved comments.

DuckLookup may delay publication of sightings for safety and privacy reasons.

Comments and moderation

Comments may be reviewed, edited, rejected, or removed before or after publication.

Comments submitted through DuckLookup may be reviewed by DuckLookup moderators or automated moderation systems.

The original submitted text may be retained for moderation, safety, abuse prevention, and recordkeeping purposes even when a comment is edited, rejected, or removed from public view.

Do not submit personal information about yourself or another person in a comment.

Technical information

Like most websites, DuckLookup and its infrastructure providers may automatically process limited technical information necessary to operate and protect the service. This may include information such as IP address, browser information, request timestamps, and security or application logs.

We do not use DuckLookup to track the physical location of individual finders.

Accounts and purchases

If DuckLookup offers account or purchasing features, information necessary to operate those features may be collected, including email address, order information, shipping information, and purchase history.

Payment information may be processed by a third-party payment provider. DuckLookup does not need to store full payment-card numbers.

Children and families

DuckLookup is designed to be family-friendly, but DuckLookup does not attempt to identify individual people who scan ducks.

Parents and guardians should supervise children's use of the internet and may use device or parental-control tools if they do not want a child to access DuckLookup.

Users should never submit a child's name, contact information, cabin number, precise whereabouts, or other personal information in a comment.

Service providers

DuckLookup may use service providers to host the website, store data, send operational messages, provide security, moderate content, or perform other functions necessary to operate the service.

Those providers may process information on DuckLookup's behalf as needed to provide their services.

Retention

DuckLookup may retain information for as long as reasonably necessary to operate the service, maintain the historical journey of ducks, investigate abuse, comply with legal obligations, and protect the safety and integrity of the platform.

Public information may be removed or modified when appropriate, but some underlying records may be retained for operational or safety purposes.

Security

We use reasonable technical and organizational measures intended to protect DuckLookup and the information stored within it. No internet service can guarantee absolute security.

Questions and requests

You may contact DuckLookup to ask questions about privacy or request review of information you believe should not appear publicly.

Because anonymous duck sightings are not necessarily associated with an identifiable account, DuckLookup may not always be able to determine who submitted a particular anonymous sighting.

Changes to this policy

We may update this Privacy Policy as DuckLookup changes. The latest version will be posted on this page with an updated revision date.
